Article 1 - Definitions
1.1 In these general terms and conditions the following terms shall have the following meanings:

• Sweet Things : the business that sells sweets and related products, established in the Netherlands and registered with the Chamber of Commerce under number [94633975].
• Customer : the natural or legal person who enters into an agreement with Sweet Things.
• Products : all sweets and other products offered by Sweet Things.

Article 2 - Applicability
2.1 These general terms and conditions apply to all offers, orders and agreements of Sweet Things.
2.2 By placing an order, the customer agrees to these general terms and conditions.
2.3 Deviations from these general terms and conditions are only valid if agreed in writing.

Article 3 - Offers and prices
3.1 All offers from Sweet Things are without obligation and valid while stocks last.
3.2 The stated prices include VAT, unless otherwise stated.
3.3 Sweet Things reserves the right to change prices, but orders already placed will be delivered at the price applicable at the time of the order.

Article 4 - Orders and agreements
4.1 An agreement is concluded at the moment that Sweet Things accepts the customer's order.
4.2 Sweet Things reserves the right to refuse orders without giving any reason.

Article 5 - Payment
5.1 Payment must be made via the offered payment methods, such as iDEAL, cash in store or other available options.
5.2 In the event of late payment, Sweet Things reserves the right to suspend delivery or terminate the agreement.

Article 6 - Delivery
6.1 Delivery will take place at the address specified by the customer or in the store.
6.2 Sweet Things strives to deliver the products within the agreed term. Exceeding this term does not entitle to compensation or termination of the agreement.
6.3 The risk of damage or loss of the products passes to the customer at the time of delivery.

Article 7 - Returns and complaints
7.1 Due to the nature of the products (food), they cannot be returned unless there is a defect.
7.2 Complaints about the products must be reported to Sweet Things in writing or by e-mail within 7 days of delivery.
7.3 In the event of justified complaints, Sweet Things will choose to replace the product or refund the purchase price.

Article 8 - Liability
8.1 Sweet Things is not liable for indirect damage, including consequential damage or lost profits.
8.2 Sweet Things' liability remains limited to the purchase price of the product.
8.3 Sweet Things is not responsible for allergic reactions to products. Customers are responsible for checking the ingredients themselves.

Article 9 - Privacy
9.1 Sweet Things processes personal data of customers in accordance with the applicable privacy legislation (GDPR).
9.2 Customer data will only be used to process orders and will not be shared with third parties unless this is necessary for the execution of the agreement.

Article 10 - Force Majeure
10.1 Sweet Things is not liable for delays or failure to fulfill obligations due to force majeure, such as pandemics, transport problems, disruptions or other circumstances beyond the control of Sweet Things.

Article 11 - Applicable law
11.1 All agreements and disputes with Sweet Things are exclusively governed by Dutch law.
11.2 Any disputes will be submitted to the competent court in the district where Sweet Things is established.

Article 12 - Amendments
12.1 Sweet Things reserves the right to change these general terms and conditions. The changed terms and conditions will be published on the website and will apply to new agreements.
